After successfully gaining permission for a two storey front and side extension, an application has been submitted to subdivide the property to provide an affordable two bed end terrace, while converting the original dwelling back to a three bed family home.
A comprehensive application was submitted to support the scheme, with:

- Planning Statement
- Design and Access Statement.

Being instructed by a local architect (after two failed attempts by others) Progress Planning project managed the Discharge of Condition Application to discharge the 20 conditions imposed upon the approval, while negotiating with Council Officers to clarify and successfully resolve the alleged unlawful development and associated enforcement matters. This ensured the scheme could be implemented before the expiry of the consent and the permission remain in perpetuity.

After advising the client of the sites development potential for this semi-detached property, a scheme was submitted to provide an enlarged living area at ground floor by extending to the rear by 3.5m in depth across the width of the property. At first floor the extension changes the existing box room to a new master bedroom, providing the property with three double bedrooms. The porch to the front provides a larger entrance/hallway with shower room and downstairs W/C, transforming the existing property into a modest and modern family home.

The client believed planning permission was not required as the neighbour had applied for the same extension in 2008 when it was deemed to be permitted development. However the neighbour began building in 2010 after the regulations had changed and the client followed suit. It was at this point that Progress Planning was contacted and advised that the extension required full planning permission as it was no longer permitted development and thus unlawful.
As the depth of the extension was over 4m and against the Council’s development guidelines the Council advised that they would not support the application as the neighbouring extension was not a material planning consideration. However after extensive correspondence and negotiations with the Council, Progress Planning successfully gained planning permission for our client and neutralised any action being taken against the neighbour for no additional cost!
Sometimes the smallest development can be the most problematic!
